Who typically arranges public liability cover

Public liability is relevant to any business where third parties can be injured or their property damaged as a result of the operations. In South Africa the cover is standard for the following categories:

  • Retailers, cafés, restaurants and hospitality venues. High public footfall and slip-and-trip exposure.
  • Tradespeople and contractors. Builders, plumbers, electricians and other on-site trades where property damage or injury to non-employees is a live risk.
  • Consulting engineers, architects and other professionals with client-facing operations. PL sits alongside professional indemnity; the two respond to different loss types.
  • Medical practitioners and clinics. Public liability sits alongside medical malpractice cover for premises-related injury.
  • Manufacturers and distributors of consumer products. Where products can cause injury or damage after they leave the business (products liability extension).
  • Property owners, landlords, body corporates. Third-party liability arising from the property itself.
  • Event organisers, cleaning services, security operators. Activity-based exposures where third-party contact is central to the operation.

Common gaps and exclusions to check

Public liability is a broad cover but it has boundaries. Common gaps that catch SA businesses:

  • Employee injury. Injuries to your own employees are covered by the Compensation for Occupational Injuries and Diseases Act (COIDA), not public liability.
  • Contractual liability beyond common law. Liability the business voluntarily assumes under contract can exceed what a standard PL wording responds to.
  • Sub-contractor liability. Whether their acts trigger PL cover depends on the wording and whether they are named or hold their own policies.
  • Faulty workmanship. The cost of putting right defective work is generally excluded.
  • Design errors. Negligent professional advice or design is professional indemnity territory, not public liability.
  • Gradual pollution. Only sudden and accidental pollution is typically covered.
  • Product recall. The cost of recalling a product is a separate cover class from PL.

Frequently asked questions

Do all SA businesses need public liability insurance?

Public liability insurance is not compulsory by South African law for most private-sector businesses, but many commercial contracts, landlords, professional bodies and industry regulators require it before you can trade, occupy premises or bid for work. It is standard cover for any business where third parties can be injured on the premises or by the operations.

Is public liability the same as professional indemnity?

No. Public liability responds to third-party bodily injury or property damage caused by your business operations. Professional indemnity responds to financial loss caused by your professional advice or services. Many SA businesses arrange both, they cover different scenarios.

Does public liability cover product-related injury?

Standard general public liability policies do not automatically cover injury caused by products supplied by the business after they leave your control. Products liability is usually arranged as an extension to the PL policy or as a separate class of cover depending on the exposure.

What about injuries to my own employees?

Injuries to employees are covered by the Compensation for Occupational Injuries and Diseases Act (COIDA) fund in South Africa, not by public liability. Public liability responds to injuries to third parties, customers, visitors, contractors, members of the public.

Does public liability cover sub-contractors I engage?

It depends on the specific policy wording and whether the sub-contractors are named or hold their own PL cover. Sub-contractor liability is one of the areas where wordings differ most between insurers and where a broker review adds real value.

How is the required limit determined?

Limits are structured against the specific exposure. Industry, activities, contract requirements, public access, sub-contracting, product supply and the size of potential claims that could arise from the business. Berkley Risk reviews the exposure and structures a limit and layer arrangement that reflects the risk rather than a generic default.

Can public liability be combined with other covers?

Public liability is often arranged as part of a combined commercial package that includes property, business interruption, cyber, D&O or professional indemnity. Whether combined or standalone, the PL wording itself does not change, what changes is the administrative and pricing arrangement.

How do I get a public liability review from Berkley Risk?

Get in touch via the appointment form on this page. Berkley Risk conducts a structured review of your existing cover position, the specific exposures in your business, and the market options available for the class of risk. The review is independent of any specific insurer.
